FUNDAMENTOS DE DERECHO

La normativa aplicable exige que los accesos a las Zonas de Bajas Emisiones estén debidamente señalizados de forma clara y visible para los conductores con la suficiente antelación. En el momento de los hechos, la señalización vertical y/o horizontal en el acceso al municipio de Yepes era inexistente, insuficiente o confusa, impidiendo al conductor conocer la prohibición antes de incurrir en ella, vulnerando los principios de legalidad y tipicidad recogidos en la Ley de Seguridad Vial.

SEGUNDO.- CORRECTO FUNCIONAMIENTO Y HOMOLOGACIÓN DE LOS SISTEMAS DE CAPTACIÓN DE IMÁGENES. Se solicita expresamente que se aporte al expediente el certificado de homologación, verificación periódica y control metrológico del dispositivo automatizado de lectura de matrículas que captó el vehículo, así como el reportaje fotográfico indubitado que acredite fehacientemente la comisión de la infracción.
