Se invocan los artículos correspondientes del Real Decreto Legislativo 6/2015, de 8 de octubre, por el que se aprueba el texto articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, así como la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, relativa a la carga de la prueba y la presunción de inocencia.
