De conformidad con el artículo 217 de la Ley de Enjuiciamiento Civil y los principios informadores del procedimiento administrativo sancionador, recae sobre la Administración la carga de probar los hechos constitutivos de la infracción. Se solicita expresamente la aportación del informe técnico de homologación y calibración del dispositivo de captación de imágenes (cámara), así como el certificado de control metrológico en vigor que acredite la fiabilidad del sistema automatizado.
