HECHOS Y FUNDAMENTOS DE DERECHO

PRIMERO.- FALTA DE SEÑALIZACIÓN ADECUADA O ERROR EN LA MEDICIÓN.
Que el vehículo de mi propiedad circulaba por la zona señalada sin que constara una debida, visible y clara señalización vertical que advirtiera de las limitaciones de acceso a la ZBE en ese tramo concreto, vulnerando los principios de legalidad y tipicidad recogidos en la Ley de Seguridad Vial.

SEGUNDO.- EXCEPCIONES Y AUTORIZACIONES APLICABLES.
Que el vehículo denunciado [marcar o adaptar según proceda: dispone de la etiqueta ambiental correspondiente / se encontraba en uno de los supuestos excepcionales de acceso autorizado, tales como residentes, carga y descarga autorizada o emergencias], por lo que la sanción carece de fundamento fáctico.

TERCERO.- INDEFENSIÓN Y FALTA DE PRUEBA.
Que la denuncia no aporta elementos probatorios suficientes (fotografía nítida donde se aprecie fehacientemente la matrícula y la señalización de la ZBE en el momento exacto de la infracción), revirtiendo la carga de la prueba en la administración sancionadora.

Por todo lo expuesto,

SOLICITO A ESTE AYUNTAMIENTO:
Que tenga por presentado este escrito en tiempo y forma, lo admita a trámite y, previos los trámites legales oportunos, tenga por formuladas las alegaciones y ACUERDE EL ARCHIVO DEL EXPEDIENTE SANCIONADOR, dejando sin efecto la multa impuesta.
