FUNDAMENTOS DE DERECHO
ÚNICO.- Resulta de aplicación el Real Decreto Legislativo 6/2015, de 8 de octubre, por el en que se aprueba el texto articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, así como el Real Decreto 320/1994, por el que se aprueba el Reglamento de Procedimiento Sancionador en materia de tráfico, circulación de vehículos a motor y seguridad vial. Asimismo, se invoca la presunción de inocencia consagrada en el artículo 24.2 de la Constitución Española, la cual no queda desvirtuada al carecer la denuncia de los elementos probatorios suficientes y fehacientes sobre la correcta señalización de la ZBE en el momento de los hechos.
