PRIMERO. ALEGACIONES

PRIMERA.- Falta de presunción de veracidad y ausencia de prueba gráfica suficiente.
La denuncia formulada se basa únicamente en la apreciación subjetiva del agente o en un sistema automatizado de captación de imágenes que, en el presente caso, no acredita de manera fehaciente e inequívoca que el vehículo se encontrara cruzando la línea de detención con la fase roja del semáforo ya iniciada de forma completa, ni aporta los fotogramas secuenciados preceptivos que demuestren la comisión de la infracción y el correcto funcionamiento y homologación del dispositivo cinemómetro o sistema de control fotográfico.

SEGUNDA.- Sobre el margen de seguridad y la fase de luz ámbar/amarilla.
Los hechos denunciados pudieron producirse durante la transición de la fase verde a la roja (luz ámbar), estando obligado el conductor a detenerse únicamente cuando la detención pueda hacerse en condiciones de seguridad suficientes, evitando frenadas bruscas que pongan en peligro la seguridad vial de los vehículos posteriores. El sistema de control no ha tenido en cuenta estas circunstancias técnicas de seguridad en la vía pública de Castellar-Oliveral.
