ALEGACIONES
PRIMERA.- Que el artículo 87 de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial exige que las denuncias de carácter automatizado contengan datos precisos y verificables sobre la medición de velocidad, incluyendo los márgenes de error reglamentarios y la certificación de homologación y verificación periódica del cinemómetro.
SEGUNDA.- Que en la denuncia notificada no se acreditan fehacientemente los metadatos completos del tramo controlado, ni constan de forma clara los certificados de control metrológico aplicados a la totalidad de los dispositivos de lectura de entrada y salida que componen el sistema de radar de tramo.
TERCERA.- Que el artículo 217 de la Ley de Enjuiciamiento Civil impone la carga de la prueba a quien formula la acusación, debiendo la Administración aportar las pruebas gráficas y técnicas indubitadas que garanticen que no ha existido fallo en el sistema de cálculo de tiempos y distancias del radar de tramo.
