HECHOS Y FUNDAMENTOS DE DERECHO

TERCERO.- Vulneración de la presunción de inocencia. Al no constar debidamente acreditados los requisitos técnicos y metrológicos del dispositivo de control de velocidad, decae la presunción de veracidad del agente o sistema automatizado, conforme al artículo 53 del Real Decreto Legislativo 6/2015 (Ley de Tráfico).

SOLICITA a esta Jefatura Provincial de Tráfico que tenga por presentado este escrito, lo admita a trámite, y tenga a bien:
