ALEGACIONES

PRIMERA.- FALTA DE PLENA GARANTÍA DE FIABILIDAD DEL SISTEMA DE MEDICIÓN (RADAR DE TRAMO). El sistema de radar de tramo calcula la velocidad media de un vehículo entre dos puntos separados por una distancia considerable. Para que dicha medición sea jurídicamente válida, la Administración debe acreditar fehacientemente la sincronización exacta de los relojes de ambos pórticos y la homologación íntegra de todo el tramo, extremo que no queda plenamente acreditado en la denuncia notificada.

SEGUNDA.- SOLICITUD DE PRUEBAS E INCUMPLIMIENTO DE LA NORMATIVA DE CONTROL METROLÓGICO. Se solicita aportar al expediente el certificado de verificación periódica o inicial del cinemómetro correspondiente al año en curso, así como el certificado de control metrológico de los elementos de lectura de matrículas y cámaras que componen el radar de tramo, debiendo constar el margen de error máximo permitido (MPE) aplicado, de conformidad con la Orden ITC/3123/2010.

TERCERA.- PRESUNCIÓN DE INOCENCIA. Salvo prueba en contrario debidamente contrastada, rige el principio constitucional de presunción de inocencia (art. 24.2 de la Constitución Española), correspondiendo a la Administración la carga de probar los hechos imputados y el perfecto funcionamiento del equipo automatizado en el momento exacto de los hechos.
