FUNDAMENTOS DE DERECHO

 

PRIMERO.- PRESUNCIÓN DE INOCENCIA. De conformidad con el artículo 53 de la Ley de Procedimiento Administrativo Común y la jurisprudencia aplicable, toda sanción requiere la prueba de cargo fehaciente que desvirtúe la presunción de inocencia consagrada en el artículo 24 de la Constitución Española.

 

SEGUNDO.- METROLOGÍA Y GARANTÍAS TÉCNICAS. Es obligación de la Administración aportar el certificado de verificación periódica del cinemómetro (radar de tramo), así como el margen de error máximo permitido (EMMP) aplicable según la Orden Ministerial de control metrológico, extremos que deben constar en el expediente sancionador.

 

Por lo expuesto,

 

SOLICITA A LA JEFATURA PROVINCIAL DE TRÁFICO:

 

1. Tenga por presentado este escrito en tiempo y forma, admitiéndolo a trámite y uniéndolo al expediente de su razón.

2. Se acuerde la práctica de las pruebas propuestas, requiriendo a este efecto:

    - Certificado de control metrológico y última revisión periódica del radar de tramo implicado.

    - Fotografías íntegras y homologadas del inicio y final del tramo vigilado donde conste la medición horaria.

    - Informe técnico que acredite la correcta señalización vertical y horizontal del tramo de velocidad limitada.

3. Tras los trámites oportunos, se dicte resolución por la que se acuerde el ARCHIVO DEL EXPEDIENTE SANCIONADOR, al no quedar acreditados fehacientemente los hechos denunciados.
