A los anteriores hechos son de aplicación los siguientes

FUNDAMENTOS DE DERECHO

ÚNICO.- La presunción de veracidad de los agentes de la autoridad y de los medios técnicos debidamente homologados puede ser desvirtuada mediante la aportación de pruebas o la puesta en duda de las garantías metrológicas exigidas por la normativa vigente. La carga de la prueba sobre el correcto estado de los cinemómetros recae sobre la Administración.

En su virtud,

SOLICITO A ESTE ORGANISMO:

Que tenga por presentado este escrito, lo admita a trámite, y tenga por formuladas alegaciones en tiempo y forma contra la denuncia de referencia, acordando el archivo de las actuaciones y la anulación del expediente sancionador, y solicitando expresamente:

1. Que se aporte el certificado de última verificación periódica del radar de tramo (tanto de los dispositivos de lectura de matrículas en el punto de inicio como de fin).
