MOTIVOS DE OPOSICIÓN:

2. Vulneración del principio de presunción de inocencia (Art. 24.2 de la Constitución Española). La carga de la prueba sobre la efectiva comisión de la infracción recae sobre la Administración. En los expedientes de radar de tramo, es indispensable aportar los fotogramas tanto del vehículo a la entrada como a la salida del tramo controlado, donde se aprecie claramente la matrícula y el entorno, garantizando que no ha existido interferencia de otros vehículos.
