ÚNICO.- Resulta de aplicación el artículo 24 de la Constitución Española relativo al derecho fundamental a la presunción de inocencia, así como el artículo 53 y concordantes de la Ley de Procedimiento Administrativo Común y la Ley de Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, que exigen la carga de la prueba por parte de la Administración para desvirtuar la presunción de inocencia del denunciado.

SOLICITA A ESTE ÓRGANO:
