SEGUNDO.- Que la carga de la prueba recae sobre la administración denunciante, debiendo desvirtuar la presunción de inocencia consagrada en el artículo 24 de la Constitución Española mediante pruebas fehacientes e inequívocas (tales como material gráfico o fotográfico indubitado), no siendo suficiente la mera apreciación subjetiva del agente cuando esta es discutida.
