HECHOS

TERCERO.- Que la denuncia se sustenta exclusivamente en la apreciación subjetiva del agente de la autoridad, careciendo de la presunción absoluta de certeza al no aportarse prueba gráfica o fotográfica inequívoca que desvirtúe el principio de presunción de inocencia consagrado en el artículo 24 de la Constitución Española, máxime cuando las condiciones de visibilidad y la posición del agente hacían materialmente imposible percibir con total certeza el uso del dispositivo.
A los anteriores hechos son de aplicación los siguientes,
FUNDAMENTOS DE DERECHO
I. El artículo 24.2 de la Constitución Española, que consagra el derecho fundamental a la presunción de inocencia, el cual vincula a todos los órganos administrativos en el ejercicio de su potestad sancionadora.
II. El artículo 53 y concordantes de la Ley del Procedimiento Administrativo Común de las Administraciones Públicas, sobre los derechos de los interesados en el procedimiento administrativo.
III. El Real Decreto Legislativo 6/2015, de 30 de octubre, por el que se aprueba el texto articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial.
