How to Claim for Bad Car Repairs in La Roca del Vallès: Download Your Free Complaint Template (Word & PDF)
Finding out that your car has been poorly repaired or damaged due to mechanic negligence is incredibly frustrating. In Spain, car workshops are heavily regulated, and consumers are protected by strict municipal and national laws. If a mechanic in La Roca del Vallès has performed a substandard repair, charged you for unapproved work, or caused further damage to your vehicle, you must act quickly. This guide explains how to file a formal complaint and provides a bilingual legal template to demand a resolution from the workshop.
How and Where to Submit Your Complaint in La Roca del Vallès
To ensure your claim has legal weight, you must follow a specific procedure. If the workshop refuses to resolve the issue amicably, follow these steps in La Roca del Vallès:
- Step 1: Request the Official Complaint Leaflet (Hojas de Reclamaciones): By law, every active workshop in Catalonia must provide you with these official triplicate forms upon request. If they refuse, you can call the Local Police (Policia Local de La Roca del Vallès) to report the refusal.
- Step 2: Send a Formal Written Demand: Before escalating to court, send the bilingual template below via Burofax (a secure postal method in Spain that certifies the content and delivery) to the workshop's registered address. This serves as undeniable proof of your attempt to resolve the issue.
- Step 3: Submit to the Consumer Office (OMIC): If the workshop does not reply within 14 business days, submit your claim to the local consumer authorities. In La Roca del Vallès, you can file this at the Oficina d'Atenció al Ciutadà (OAC) of the Town Hall (Ajuntament de La Roca del Vallès):
- Address: Carrer de Catalunya, 24, 08430 La Roca del Vallès, Barcelona.
- Online Submission: You can also submit your claim digitally via the Seu Electrònica of the Ajuntament using an idCAT Mòbil or Cl@ve digital certificate.

Additional Documentation Required
When presenting this claim to the workshop or submitting it later to the OMIC in La Roca del Vallès, you must attach copies (never hand over the originals) of the following evidence:
- The Repair Estimate (Presupuesto): In Spain, workshops must provide a written estimate. If they repaired your car without your signed consent, this is a major infraction.
- The Invoice (Factura): Proof of what you paid and the specific parts/labor the workshop claimed to have performed.
- Proof of Payment: Bank transfer confirmation, credit card receipt, or cash receipt.
- A Technical Report (Informe Pericial): If the damage is severe, obtaining a report from an independent mechanic or an official vehicle inspector (ITV/Perito) stating that the repair was negligent will guarantee your success.
- Photographs or Videos: Clear visual evidence of the poor repair or new damages caused to the bodywork or engine.
Expert Tips for Handling Spanish Mechanic Disputes
Always remember that under Spanish Consumer Law, you have a legal warranty on all repairs. For passenger cars, this warranty is 3 months or 2,000 kilometers (whichever comes first). If the workshop claims they are not responsible because you "signed a waiver," ignore them; consumer rights in Spain cannot be waived by private contracts. Additionally, always make sure to communicate via Burofax or by getting them to stamp and sign your copy of the complaint letter directly at their reception desk. This ensures they cannot claim they never received your complaint.
