How to Claim for Hidden Defects in a Used Car in Los Camachos: Downloadable Template
Buying a used car can be a stressful experience, especially when you discover mechanical issues shortly after the purchase. In Spain, you are protected by the Civil Code against "vicios ocultos" (hidden defects). These are pre-existing faults that were not apparent at the time of sale and make the vehicle unfit for its intended use. If you purchased a vehicle in or around Los Camachos, this template will help you formally demand a repair or a price reduction from the seller.
Instructions on how and where to submit your claim in Los Camachos
This document is a formal "Burofax." In Spain, sending a notification via Burofax through Correos is the only way to ensure legal proof of both the content sent and the date of receipt. Follow these steps:
- Fill in the bracketed information in the template below.
- Print two copies: one for the seller and one for your personal records.
- Go to your nearest Correos office (the closest branches serving the Los Camachos area are located in Cartagena).
- Request a "Burofax con acuse de recibo y certificación de texto." This provides you with an official certificate that the recipient received the document.
- Keep the receipt provided by the post office as it serves as legal evidence should the case proceed to a court in Cartagena.

Additional documentation required
To strengthen your claim, you must attach copies of the following documents to your Burofax:
- A copy of the "Contrato de Compraventa" (Purchase Contract).
- A detailed repair estimate or report from a trusted mechanic (taller) in the Cartagena/Los Camachos area confirming the defect pre-existed the sale.
- Photocopies of any correspondence (WhatsApp, emails) where the seller confirms the vehicle's condition prior to the sale.
Expert Tip: Do not attempt to repair the vehicle yourself before sending this notice. If you pay for repairs before notifying the seller, you may lose your legal right to claim a refund, as you have effectively modified the evidence. Always consult with a local consumer protection office (OMIC) in Cartagena if the seller refuses to respond to your Burofax within 10 business days.
