Que mediante el presente escrito, y dentro del plazo legalmente establecido de 20 días hábiles a contar desde el día siguiente al de la notificación de la denuncia, por medio del presente escrito comparezco y, en su mérito, FORMULO ALEGACIONES contra la denuncia de tráfico referida al margen, en base a los siguientes:

FUNDAMENTOS DE DERECHO

ÚNICO.- Es de aplicación el Real Decreto Legislativo 6/2015, de 30 de octubre, por el que se aprueba el texto articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, así como la Ordenanza Municipal reguladora del estacionamiento limitado en Cartes. Corresponde a la administración la carga de la prueba sobre los hechos denunciados, debiendo prevalecer el principio de presunción de inocencia (art. 217 de la Ley 39/2015) en caso de contradicción o falta de pruebas concluyentes aportadas por el servicio denunciante.
