FUNDAMENTOS DE DERECHO

I. Sobre la presunción de inocencia consagrada en el artículo 24.2 de la Constitución Española, que desvirtúa cualquier imputación carente de pruebas gráficas o testificales fehacientes.

II. Sobre la tipificación de los hechos y la carga de la prueba que recae sobre la Administración actuante.
