FUNDAMENTOS DE DERECHO

ÚNICO.- Se invoca el principio de presunción de inocencia consagrado en el artículo 24.2 de la Constitución Española, así como el artículo 87 de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, toda vez que la denuncia no aporta elementos probatorios suficientes y válidos que acrediten fehacientemente la comisión de los hechos imputados y el correcto funcionamiento del radar.

Por lo expuesto,
