Comparezco y, como mejor proceda en Derecho, EXPONGO:

MOTIVOS DE OPOSICIÓN:

1. Falta de acreditación del margen de error del cinemómetro (radar).
La denuncia ha sido formulada mediante aparato medidor de velocidad. No consta en la denuncia aportada el certificado de verificación periódica o metrológica del cinemómetro, ni se especifica el margen de error aplicable según la Orden ITC/3722/2006, de 22 de noviembre, que regula el control metrológico del Estado sobre los instrumentos de medida de velocidad. La aplicación estricta del margen de error podría situar la velocidad real por debajo del umbral sancionable.

2. Indefensión por carencia de elementos probatorios suficientes.
Se solicita expresamente a esta Jefatura la aportación de la fotografía original y en alta resolución obtenida por el cinemómetro, donde se aprecie claramente el vehículo, la matrícula y las condiciones de la vía, garantizando que no existían otros vehículos que pudieran inducir a error en la medición (efecto de adelantamiento o proximidad).

Por lo expuesto,
