HECHOS Y ALEGACIONES

PRIMERO.- Falta de acreditación de la aplicación de los márgenes de error legalmente establecidos.

SEGUNDO.- Solicitud de prueba de verificación del cinemómetro.
A efectos de desvirtuar la presunción de veracidad de la denuncia, solicito expresamente que se incorpore al expediente el Certificado de Verificación Técnica del cinemómetro utilizado para la captación de la supuesta infracción. Este certificado debe estar vigente en la fecha de los hechos y haber sido expedido por un organismo de control metrológico autorizado, demostrando que el aparato superó las revisiones periódicas anuales obligatorias.

TERCERO.- Falta de nitidez en la prueba fotográfica y ausencia de otros elementos de convicción.
