PRIMERA.- De conformidad con el artículo 90 de la Ley de Seguridad Vial, la denuncia adolece de falta de acreditación fehaciente de la infracción imputada, al no aportarse en la notificación inicial la fotografía captada por el cinemómetro (radar) que permita identificar sin género de dudas el vehículo, la matrícula y las condiciones de la vía.

SEGUNDA.- Asimismo, se solicita expresamente la aportación al expediente del certificado de homologación del cinemómetro utilizado, así como el certificado de la última verificación periódica (control metrológico) efectuada al mismo, de acuerdo con la Orden ITC/3122/2006, con el fin de comprobar que el aparato se encuentra dentro de los márgenes legales de error permitidos.

TERCERA.- Que la notificación no especifica de manera correcta el margen de error aplicable al cinemómetro según su ubicación (fijo o móvil), vulnerando los principios de presunción de inocencia y seguridad jurídica garantizados en la Constitución Española.
