Que he recibido notificación de la denuncia formulada en el expediente sancionador número ________________________, por una presunta infracción de tráfico por exceso de velocidad detectada por cinemómetro (radar), y no estando conforme con la misma, procedo a formular el presente ESCRITO DE ALEGACIONES en base a los siguientes:
HECHOS Y FUNDAMENTOS DE DERECHO
PRIMERO.- Falta de acreditación de la calibración del cinemómetro. De conformidad con la Orden ICT/155/2020, de 7 de febrero, por la que se regula el control metrológico del Estado de los instrumentos de medida, todo cinemómetro utilizado para la formulación de denuncias de velocidad debe estar sometido a verificaciones periódicas anuales. Solicito que se aporte al expediente el certificado de verificación periódica en vigor del aparato empleado, expedido por un organismo de control metrológico autorizado, para comprobar que cumple con los requisitos legales en la fecha de la denuncia.
SEGUNDO.- Falta de aplicación de los márgenes de error legalmente establecidos. La velocidad que consta en la denuncia debe ser corregida aplicando el margen de error legal establecido en la citada Orden ICT/155/2020 (un 3%, 5% o 7% según el tipo de radar y la velocidad de la vía). Si la velocidad que figura en la denuncia coincide exactamente con la registrada por el cinemómetro sin aplicar dicha deducción a favor del conductor, la sanción resultaría nula por vulneración del principio de presunción de inocencia (Art. 53 de la LPACAP y Art. 24.2 de la Constitución Española).
TERCERO.- Defecto en la prueba fotográfica. Se solicita la aportación de la fotografía original captada por el radar en la que conste de forma clara e inequívoca la matrícula del vehículo denunciado. Asimismo, en caso de que en la imagen aparezca más de un vehículo circulando en paralelo o en el mismo campo de visión, la prueba carece de validez al no poder determinarse con total seguridad cuál de los vehículos cometió la presunta infracción.
Por todo lo expuesto,
SOLICITO: Que se tenga por presentado este escrito de alegaciones, se admita a trámite, se incorporen al expediente administrativo las pruebas documentales solicitadas (certificado de calibración del radar y fotografía original donde se visualice la matrícula y el entorno de medición), y tras los trámites oportunos, se dicte resolución por la que se acuerde el archivo y sobreseimiento del presente expediente sancionador sin imposición de sanción alguna.
