HECHOS

SEGUNDO.- Que el artículo correspondiente del Reglamento General de Vehículos sanciona la circulación, mas no la mera tenencia o estacionamiento sin ITV en la vía pública (salvo ordenanza municipal específica que regule el estacionamiento en estas condiciones, lo cual no consta debidamente acreditado en el presente expediente).

FUNDAMENTOS DE DERECHO

ÚNICO.- Se invoca el principio de presunción de inocencia consagrado en el artículo 53 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, así como en el Texto Articulado de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial, al no haberse aportado prueba fehaciente de los hechos imputados o concurrir causa justificativa.

Por lo expuesto,

SOLICITO A ESTE ORGANISMO:

Que tenga por presentado este escrito, lo admita a trámite, tenga por formuladas en tiempo y forma alegaciones y, en su virtud, acuerde el ARCHIVO DEL EXPEDIENTE SANCIONADOR al no ajustarse la denuncia a derecho.
