CLÁUSULAS / CLAUSES
Primera. Objeto y gratuidad. El COMODANTE cede en uso gratuito (comodato) al COMODATARIO el vehículo descritos en el expositivo primero. El presente contrato tiene carácter estrictamente gratuito; por tanto, no genera obligación de pago alguno en concepto de alquiler.
First. Object and gratuitousness. The LENDER yields for free use (comodato) to the BORROWER the vehicle described above. This contract is strictly gratuitous; therefore, it does not generate any payment obligation as rent.
Segunda. Duración. El presente contrato entra en vigor el día de la fecha y tendrá una duración de [Indicar duración, ej. 6 meses / Indefinida a falta de revocación]. El COMODANTE podrá reclamar la devolución del vehículo en cualquier momento si concurre causa justificada o necesidad urgente.
Second. Duration. This contract enters into force on the date hereof and shall last for [Indicate duration]. The LENDER may claim the return of the vehicle at any time if justified cause arises.
Tercera. Gastos de uso y mantenimiento. Serán de cuenta exclusiva del COMODATARIO todos los gastos derivados del uso del vehículo, tales como consumo de combustible, peajes, lavado, ITV (si caducara durante el periodo), así como las reparaciones derivadas de un mal uso o desgaste ordinario. El seguro obligatorio seguirá pagándolo el COMODANTE, si bien el COMODATARIO se obliga a cumplir con todas las condiciones de la póliza.
Third. Expenses and maintenance. All expenses derived from the use of the vehicle, such as fuel, tolls, washing, ITV, and ordinary maintenance, shall be borne exclusively by the BORROWER. Mandatory insurance shall continue to be paid by the LENDER, though the BORROWER must comply with the policy terms.
Cuarta. Infracciones y multas. El COMODATARIO asume íntegramente la responsabilidad por cualquier infracción de las normas de tráfico, seguridad vial o normativa municipal cometida durante el periodo de vigencia de este préstamo, comprometiéndose a abonar las multas y sanciones que pudieran imponerse.
Fourth. Infractions and fines. The BORROWER assumes full responsibility for any traffic or municipal infractions committed during the loan period, committing to pay all resulting fines and penalties.
