Free Vehicle Loan Agreement (Comodato) in Osorno: Download Template (Word/PDF)
If you are planning to lend your car to a family member, a trusted friend, or an employee in Spain without any financial compensation, you need a formal legal document known in Spanish as a Contrato de Comodato de Vehículo. This is a free vehicle loan agreement that protects both the owner and the driver, clarifying responsibilities regarding fines, maintenance, and insurance while avoiding tax pitfalls with the Spanish authorities.
Instructions on how and where to submit it in Osorno
Unlike administrative fine appeals, a Contrato de Comodato is a private agreement between two parties and does not need to be actively "submitted" to a municipal office in Osorno (Palencia) to take effect. However, for maximum legal security, it is highly recommended to follow these local steps:
- Signatures: Both parties must sign and date every page of the physical contract.
- Notarization (Optional but Recommended): You can take the signed contract to a local notary in the Palencia province to have the signatures officially witnessed (legitimación de firmas), giving it robust evidentiary weight in court or before insurance companies.
- DGT Notification: While not strictly mandatory for a temporary free loan, if the vehicle will be driven permanently by someone else, you can notify the DGT (Dirección General de Tráfico) or simply keep a signed copy of this contract inside the glove compartment at all times to prove authorized use if stopped by the Guardia Civil or local police.
