CLÁUSULAS / CLAUSES

FIRST (Gratuitous Nature): This contract constitutes a commodatum regulated by Articles 1740 and following of the Spanish Civil Code. The loan is entirely free of charge (gratuitous); no economic compensation, rent, or payment of any kind is requested or expected.

PRIMERA (Carácter Gratuito): El presente contrato constituye un comodato regulado por los artículos 1740 y siguientes del Código Civil. El préstamo es totalmente gratuito; no se exige ni se espera contraprestación económica, renta ni pago de ningún tipo.

SECOND (Duration): The loan shall commence on [Fecha de inicio] and will conclude on [Fecha de fin / o "a requerimiento del Comodante"].

SEGUNDA (Duración): El préstamo comenzará el [Fecha de inicio] y concluirá el [Fecha de fin / o "a requerimiento del Comodante"].

THIRD (Use of the Vehicle): The BORROWER undertakes to use the vehicle exclusively for private and lawful purposes, respecting traffic regulations at all times. It is strictly forbidden to sublease, lend to third parties, or use the vehicle for commercial transport or illegal activities.

TERCERA (Uso del Vehículo): El COMODATARIO se compromete a usar el vehículo exclusivamente para fines particulares y lícitos, respetando en todo momento las normas de tráfico. Queda estrictamente prohibido subarrendar, prestar a terceros o destinar el vehículo al transporte comercial o actividades ilícitas.

FOURTH (Expenses and Fines): During the term of this contract, the BORROWER shall bear all expenses derived from the normal use of the vehicle, such as fuel, tolls, washing, and minor maintenance. Likewise, the BORROWER assumes full financial and legal responsibility for any traffic fines, penalties, or infractions committed while operating the vehicle.

CUARTA (Gastos y Multas): Durante la vigencia de este contrato, el COMODATARIO correrá con todos los gastos derivados del uso normal del vehículo, tales como combustible, peajes, lavado y mantenimiento menor. Asimismo, el COMODATARIO asume la total responsabilidad económica y legal por cualquier multa, sanción o infracción de tráfico cometida mientras conduzca el vehículo.

FIFTH (Insurance): The vehicle has compulsory civil liability insurance policy nº [Número de Póliza] with the company [Nombre Aseguradora]. The LENDER certifies that the insurance is active, and the BORROWER is designated or authorized to drive according to the policy terms.

QUINTA (Seguro): El vehículo cuenta con póliza de seguro de responsabilidad civil obligatoria nº [Número de Póliza] con la compañía [Nombre Aseguradora]. El COMODANTE certifica que el seguro está en vigor y que el COMODATARIO se encuentra facultado para conducir según los términos de la póliza.
