CLÁUSULAS / CLAUSES
PRIMERA. Objeto y gratuidad. El presente contrato tiene por objeto el préstamo gratuito (comodato) del vehículo descrito. El COMODATARIO no estará obligado a abonar cantidad alguna en concepto de renta o alquiler por el uso del mismo.
FIRST. Object and gratuitousness. The purpose of this contract is the free loan (comodato) of the described vehicle. The BORROWER shall not be obliged to pay any amount as rent for its use.
SEGUNDA. Duración. El préstamo del vehículo se realiza por un periodo de [Indicar duración, ej: un año / indefinido], comenzando el día [Fecha de inicio] y finalizando el día [Fecha de fin]. No obstante, el COMODANTE podrá reclamar la devolución del vehículo en cualquier momento si concurriere urgente necesidad.
SECOND. Duration. The loan of the vehicle is made for a period of [Indicate duration, e.g., one year / indefinite], starting on [Start Date] and ending on [End Date]. However, the LENDER may demand the return of the vehicle at any time in case of urgent necessity.
TERCERA. Gastos y Mantenimiento. Serán de cuenta exclusiva del COMODATARIO todos los gastos corrientes derivados del uso del vehículo, tales como consumo de combustible, peajes, lavado, ITV, así como las reparaciones derivadas del uso ordinario o negligencia. Los impuestos de circulación (IVTM) y el seguro obligatorio correrán a cargo del COMODANTE (o especificar lo contrario).
THIRD. Expenses and Maintenance. All current expenses derived from the use of the vehicle, such as fuel consumption, tolls, washing, ITV (technical inspection), as well as repairs derived from ordinary use or negligence, shall be exclusively borne by the BORROWER. Road tax (IVTM) and mandatory insurance shall be borne by the LENDER (or specify otherwise).
CUARTA. Responsabilidad y Sanciones. El COMODATARIO será único responsable de las infracciones de tráfico, multas, sanciones y daños a terceros que se produzcan desde la fecha de firma del presente contrato hasta la devolución del vehículo.
FOURTH. Liability and Penalties. The BORROWER shall be solely responsible for traffic violations, fines, penalties, and damages to third parties occurring from the date of signature of this contract until the return of the vehicle.
