CLÁUSULas / CLAUSES

PRIMERA. CARÁCTER GRATUITO. El presente contrato es de comodato, por lo que el préstamo del vehículo es estrictamente gratuito, no exigiéndose contraprestación económica alguna por su uso.
FIRST. GRATUITOUS NATURE. This contract is a comodato, meaning the loan of the vehicle is strictly free of charge, with no financial compensation required for its use.

SEGUNDA. DURACIÓN. El plazo de duración de este préstamo dará comienzo el día [Fecha inicio] y finalizará el día [Fecha fin] / será por tiempo indefinido hasta que cualquiera de las partes lo revoque mediante preaviso de [X] días.
SECOND. DURATION. The duration of this loan shall begin on [Start Date] and end on [End Date] / will be for an indefinite period until either party revokes it with [X] days notice.

TERCERA. USO DEL VEHÍCULO. El COMODATARIO se obliga a utilizar el vehículo exclusivamente para sus desplazamientos particulares/laborales, estando prohibido su uso para actividades comerciales lucrativas o cesión a terceros sin consentimiento expreso del COMODANTE.
THIRD. USE OF THE VEHICLE. The BORROWER agrees to use the vehicle exclusively for private/work trips, prohibiting its use for lucrative commercial activities or transfer to third parties without express consent from the LENDER.

CUARTA. GASTOS Y MULTAS. Serán de cuenta exclusiva del COMODATARIO todos los gastos derivados del uso del vehículo durante la vigencia del contrato, tales como combustible, peajes, mantenimiento menor, así como el pago de cuantas multas, sanciones o infracciones de tráfico sean impuestas por las autoridades competentes desde la entrega del vehículo.
FOURTH. EXPENSES AND FINES. All expenses derived from the use of the vehicle during the term of the contract, such as fuel, tolls, minor maintenance, as well as the payment of any fines, sanctions, or traffic infractions imposed by competent authorities from the delivery of the vehicle onwards, shall be borne exclusively by the BORROWER.

QUINTA. SEGURO. El vehículo cuenta con póliza de seguro obligatoria en vigor contratada por el COMODANTE. El COMODATARIO declara conocer las condiciones de la póliza y se compromete a respetar sus cláusulas, respondiendo de cualquier franquicia o recargo en caso de siniestro imputable a su negligencia.
FIFTH. INSURANCE. The vehicle has a mandatory insurance policy in force contracted by the LENDER. The BORROWER declares to know the policy conditions and agrees to respect its clauses, being responsible for any deductible or surcharge in the event of an accident attributable to their negligence.
