Download Free Vehicle Bailment Contract (Contrato de Comodato) Template for Martín de la Jara (Word/PDF)
If you are planning to lend your vehicle to a family member, trusted friend, or employee in Spain without any financial exchange, you need a legal instrument known as a Contrato de Comodato de Vehículo (Gratuitous Vehicle Loan Agreement). In Spanish civil law, "comodato" is a specific type of contract where one party delivers a non-fungible item (in this case, a car, van, or motorcycle) to another for free use, with the obligation to return it later. Having this document is vital in Martín de la Jara to protect the owner from liability regarding fines, tolls, or civil liability arising from accidents caused by the driver, while also giving the authorized driver legal proof that they are permitted to operate the vehicle.
Instructions on how and where to submit it in Martín de la Jara
While a vehicle bailment contract is a private agreement between two parties and does not strictly need to be submitted to the DGT (Directorate-General for Traffic) to be legally binding between you and the borrower, it is highly recommended to follow these practical steps in the local context of Martín de la Jara:
- Sign in Duplicate: Print two original copies of the agreement so both the lender (comodante) and the borrower (comodatario) retain a signed copy.
- Notarization (Optional but Recommended): To give the document official standing against third parties and timestamp it, you can have the signatures legitimized before a notary public (Notaría) or through the local Peace Court (Juzgado de Paz) in Martín de la Jara if available.
- Notification to DGT: Although not mandatory for simple loans, if the driver is going to use the vehicle abroad or if you want absolute administrative transparency, you can register the authorized driver at the Provincial Traffic Headquarters in Seville (Jefatura Provincial de Tráfico).
- Insurance Notification: Inform your car insurance company that another designated driver will regularly use the vehicle to avoid any coverage issues in the event of an accident.

Additional documentation required
To ensure that the vehicle loan is completely transparent and legally sound when driving around Martín de la Jara and throughout Spain, the borrower should always carry the following documents inside the vehicle:
- Permiso de Circulación (Registration Certificate): Proves who the legal owner of the vehicle is.
- Tarjeta de Inspección Técnica (ITV Card): Proof that the vehicle has passed Spain's mandatory technical inspection, along with the up-to-date sticker on the windshield.
- Proof of Insurance: The receipt showing that the compulsory third-party liability insurance is active and paid.
- Signed Copy of the Contrato de Comodato: Having this contract handy helps resolve misunderstandings immediately if stopped by local authorities (Policía Local de Martín de la Jara or Guardia Civil de Tráfico), particularly if the driver's surname differs from the owner's.
Expert Tip: Always make sure your insurance policy does not explicitly exclude drivers under a certain age or with a recently issued license. If the person borrowing your car falls into an excluded category in your policy, you could face severe financial liabilities in the event of an accident, regardless of having a signed comodato contract.
