If you are planning to lend your car, van, or motorcycle to a family member, friend, or employee in Chantada without charging any rent, you need a legal safeguard. In Spain, this arrangement is known as a Contrato de Comodato de Vehículo (Free Vehicle Bailment Contract or gratuitous loan). This document proves that the vehicle transfer is legal, temporary, and entirely free of charge, protecting both parties against unexpected liabilities such as speeding fines, tolls, or even civil liability in case of an accident.
Instructions on how and where to submit it in Chantada
Unlike a vehicle sale, a private vehicle loan does not need to be submitted to a notary to be valid between the parties, but it is highly recommended to formalize it properly. However, to ensure full legal security before the Spanish authorities (such as the DGT - Dirección General de Tráfico or local authorities in Chantada), you should follow these steps:
- Sign in Duplicate: Both the lender (comodante) and the borrower (comodatario) must sign two physical copies of the contract so each party retains an original.
- Notify the DGT (Optional but Recommended): While not strictly mandatory for simple private loans, if the vehicle is going to be driven regularly by someone else living at a different address, you can notify the DGT or keep a signed copy of this contract inside the vehicle glovebox at all times to present to local police (Policía Local de Chantada) or the Guardia Civil if pulled over.
- Local Registration / Tax Matters: Ensure that the Impuesto sobre Vehículos de Tracción Mecánica (IVTM) is paid up to date at the Chantada Town Hall (Ayuntamiento de Chantada) by the registered owner, regardless of who is driving.

Additional documentation required
To ensure that the vehicle loan is fully compliant and trouble-free while operating in Chantada or traveling across Spain, the driver should always carry the following paperwork inside the vehicle:
- The original Permiso de Circulación (Vehicle Registration Certificate) showing the owner's details.
- The original Tarjeta de ITV (Technical Inspection Card) with a valid, up-to-date inspection stamp.
- Proof of valid compulsory vehicle insurance (Recibo del seguro / certificado).
- A signed physical copy of this bilingual Contrato de Comodato to clear up any doubts in case of routine traffic stops or administrative checks by the authorities.
As an expert traffic consultant, my top recommendation is to explicitly check the vehicle insurance policy before handing over the keys. Ensure that the insurance company covers occasional or secondary drivers (conductores ocasionales/habituales), especially if the borrower is under 25 or has held their Spanish driving license for a short period. This prevents insurance companies from rejecting claims in the event of an unfortunate incident in Chantada or elsewhere.
