EXPONEN / DECLARE

Primero.- Que el COMODANTE es el propietario en pleno dominio del vehículo cuyas características son las siguientes:

CLÁUSULAS / CLAUSES

PRIMERA. - Carácter gratuito / Free nature. El presente contrato es de carácter estrictamente gratuito. El COMODATARIO no está obligado a pagar ninguna renta o contraprestación por el uso del vehículo.
This contract is strictly free of charge. The BORROWER is not obligated to pay any rent or consideration for the use of the vehicle.

SEGUNDA. - Duración / Duration. El préstamo del vehículo se realiza por un plazo de [Indicar duración, ej: 1 año / indefinido], comenzando el día de la fecha y finalizando el [Fecha de fin o indicar "hasta revocación por el comodante"].

TERCERA. - Gastos de mantenimiento y uso / Maintenance and usage costs. Serán de cuenta exclusiva del COMODATARIO todos los gastos derivados del uso del vehículo, tales como combustible, lavado, peajes, multas de tráfico, así como las reparaciones ordinarias derivadas del desgaste por su uso. El seguro obligatorio y el Impuesto sobre Vehículos de Tr. Mecánico (IVTM) correrán a cargo del COMODANTE (salvo pacto en contrario).
All expenses derived from the use of the vehicle, such as fuel, washing, tolls, traffic fines, and ordinary wear-and-tear repairs, shall be borne exclusively by the BORROWER. Mandatory insurance and municipal road tax shall be borne by the LENDER (unless otherwise agreed).

CUARTA. - Responsabilidad / Liability. El COMODATARIO será el único responsable civil y penalmente de los daños y perjuicios que puedan causarse a terceras personas o bienes con motivo de la conducción y posesión del vehículo a partir de la firma de este documento.
The BORROWER shall be solely responsible, civilly and criminally, for damages caused to third parties or property due to the driving and possession of the vehicle as of the signing of this document.
