Free Vehicle Loan Agreement (Comodato) Download for Alangua: Word & PDF Templates
If you are planning to lend your car to a family member, a friend, or an employee in Alangua without charging them rent, you need more than just a verbal agreement. In Spain, lending a vehicle for free is legally known as a comodato de vehículo. Having a properly drafted free vehicle loan agreement protects the owner from unexpected liability—such as speeding tickets, tolls, or involvement in traffic accidents—while granting the borrower the legal right to drive the vehicle. Below, you will find a complete guide on how to formalize this process in Alangua, along with a ready-to-copy bilingual template.
Instructions on how and where to submit it in Alangua
Unlike a vehicle sale, a private vehicle loan agreement does not need to be submitted to a physical window at the Town Hall (Ayuntamiento) of Alangua or the DGT (Dirección General de Tráfico) to be valid between private parties. However, to ensure full legal security and protection against third-party liabilities (like fines or civil claims), it is highly recommended to follow these steps:
- Signing: Both the owner (comodante) and the borrower (comodatario) must sign and initial every page of the physical contract.
- Notarization (Optional but Recommended): You can take the signed contract to a local notary public in the Basque Country region to officially timestamp and legitimize the signatures, giving it undeniable proof of date before third parties.
- DGT Notification (Comunicación de Conductor Habitual): If the borrower is going to use the car continuously for a long period, the owner should notify the DGT. While a comodato is technically a temporary loan, registering a regular driver ("conductor habitual") prevents fines from mistakenly arriving at the owner's address, though this is usually reserved for renting or long-term leasing. Keeping a copy of this contract inside the glove compartment at all times when driving through Alangua and the rest of Spain is mandatory to prove lawful possession if stopped by the Ertzaintza or Guardia Civil.

Additional documentation required
To ensure that the vehicle loan is fully transparent and legally bulletproof when driving around Alangua and across Spain, make sure the borrower carries the following paperwork in the vehicle:
- Permiso de Circulación (Registration Certificate): Proves vehicle ownership and technical specifications.
- Tarjeta de ITV (Technical Inspection Card): Must show that the vehicle has successfully passed its mandatory roadworthiness inspections up to date.
- Proof of Insurance (Recibo del Seguro): Proof that the mandatory third-party liability insurance is active and paid. While having the physical receipt is no longer strictly compulsory by law if traffic authorities can check it digitally, carrying it avoids roadside delays.

Expert tips for a trouble-free vehicle loan in Alangua
As an expert recommendation, always inspect the vehicle together and take dated photographs of its exterior and interior before handing over the keys. This prevents potential disputes regarding scratches, dents, or mechanical issues that might occur during the loan period. Furthermore, if you are lending the car for an extended duration, ensure that the vehicle's ITV and insurance renewal dates are properly tracked so that neither lapses while the borrower is in possession of the automobile.
